West worried by China-Pakistan atomic ties: sources

VIENNA (Reuters) - Western states pressured China at closed-door talks last week to address concerns about its plans to expand a nuclear power plant in Pakistan and provide more information, but were rebuffed, two diplomatic sources said on Wednesday.

Beijing's atomic relations with Islamabad have caused unease in Washington, Delhi and other capitals due to Pakistan's history of spreading nuclear arms technology and fears about the integrity of international non proliferation rules.

"A number of countries asked questions and expressed concerns," said one official, speaking about the annual plenary session of the 46-nation Nuclear Suppliers Group (NSG), held on June 21-22 in the U.S. city of Seattle.

But China showed no sign of reconsidering its position on building two more reactors at the Chashma nuclear power complex in Pakistan's Punjab region, the official and another source said, a stance Beijing also took when the issue was raised in last year's NSG talks in the Dutch city of Noordwijk.

As its ties with the United States have suffered, Pakistan has been trying to move closer to Asian powerhouse China, which has welcomed Islamabad's overtures.

The two-day meeting also debated the issue of India's possible membership in the NSG, a consensus-based cartel that seeks to ensure nuclear exports are not used for military purposes by agreeing rules for such trade, the sources said.

In 2010, the United States announced backing for India's membership - a step that would make it the only country outside the nuclear Non Proliferation Treaty (NPT) in the group - but Pakistan has warned against allowing its rival to join.

"If India were to apply now, there would be quite a detailed discussion on non proliferation-related issues before a decision is taken," one of the sources said, suggesting there were differences of opinion within the NSG.

A statement by the U.S. National Nuclear Security Administration confirmed that the NSG's relationship with India was discussed, but did not mention the China-Pakistan issue.

"Participating governments called on all states to exercise vigilance and make best efforts to ensure that none of their exports of goods or technologies contribute to nuclear weapons programs," it said on its website.

Close relations between China and Pakistan reflect a long-standing shared wariness of their common neighbor, India, and a desire to counter U.S. influence across the region.

Analysts say China agreed to expand Chashma to match a 2008 nuclear energy deal between India and the United States.

NUCLEAR PRINCIPLE EROSION?

Washington and other governments have said China should seek approval for the planned reactors from the NSG. But China argues that the construction of two additional units at Chashma was part of a bilateral deal sealed before it joined the NSG in 2004. China also supplied the facility's first two reactors.

European Union members of the NSG delivered a joint statement about the issue in Seattle, the two sources said. The U.S. delegation also "posed a question," one of them said.

"China basically reiterated that it comes under the grandfather clause," one source said, referring to Beijing's argument that the agreement was struck before it joined the nuclear suppliers' forum.

To receive nuclear exports, nations that are not one of the five officially recognized atomic weapons states must usually place their nuclear activities under the safeguards of the U.N. International Atomic Energy Agency, NSG rules say.

When the United States sealed a nuclear supply deal with India in 2008 that China and others found questionable because Delhi - like Islamabad - is outside the NPT, Washington won a waiver from that rule after contentious negotiations.

Pakistan wants a similar civilian nuclear agreement with the United States to help meet its growing energy needs.

But Washington is reluctant, largely because a Pakistani nuclear scientist, Abdul Qadeer Khan, admitted in 2004 to transferring nuclear secrets to North Korea, Iran and Iraq.

Pakistan tested nuclear devices in 1998, soon after India, and both nations refuse to join the NPT, which would oblige them to scrap nuclear weapons.

Nuclear analyst Mark Hibbs said there had been an erosion of the principle that recipients of nuclear exports must put all their atomic activities under IAEA safeguards.

"First by Russia a decade ago in its trade with India, then in the U.S.-sponsored India deal, and now by China's trade with Pakistan," Hibbs, of the Carnegie Endowment think-tank, said.

"Since the late 1990s we have seen a weakening of milestone non proliferation commitments by big powerful countries."

Congress passes bill increasing drug inspections

(AP) ? A Food and Drug Administration bill designed to increase inspections of foreign drug manufacturing sites, while also speeding up approvals of new drugs at home, is headed to the president's desk after an overwhelming approval in the Senate.

The Senate approved the must-pass piece of the legislation by a vote of 92-4, and President Barack Obama is expected to sign it into law within days.

The core of the bill is critical to the FDA because it bolsters the agency's budget with billions of dollars in drug industry fees, which the government uses to hire additional scientists to review new medicines.

But lawmakers seized on the legislation to address recent concerns about the safety and quality of prescription medicines, especially those that are imported. The bill also gives the FDA new tools to combat drug counterfeiting and drug shortages, which have made headlines in the past year.

"This legislation will help bring critical drugs and medical devices to market faster, protect patients from drug shortages and manufacturing problems, and enhance the availability of low-cost generic drugs," said Sens. Tom Harkin, D-Iowa, and Mike Enzi, R-Wyoming, who guided the bill through the Senate.

Public health experts said the most significant changes for consumers involve how FDA inspectors oversee foreign drug manufacturing facilities.

For more than 70 years, the agency has focused its inspections on U.S. factories. But most companies have moved their operations overseas to take advantage of cheaper labor and materials. Between 2001 and 2008 the number of U.S. drugs made outside of the country doubled, according FDA figures.

The bill passed by Congress would do away with a requirement that FDA inspect all U.S. factories every two years and give the agency more discretion to focus on foreign facilities. Currently, the FDA inspects the average foreign manufacturing facility every nine years. The new bill requires that FDA inspectors target the most problematic manufacturing sites, regardless of whether they're in the U.S. or overseas.

"This legislation will, for the first time, enable the FDA to regularly inspect foreign drug manufacturing facilities, which supply 80 percent of the ingredients in our medications," said Allan Coukell, director of the Pew Charitable Trusts' medical programs

The risks of unchecked foreign drug manufacturing hit home in 2008, when hundreds of U.S. patients suffered allergic reactions ? some fatal ? to a blood thinner imported from China. An FDA investigation concluded the drug had been contaminated, to reduce costs, with an ingredient that mimics the blood thinner heparin.

The bill would raise the maximum prison sentence for drug counterfeiting to 20 years. The maximum now is three years.

Despite months of negotiation, the bill does not include a national tracking system, which public health advocates say is critical to weeding counterfeit pharmaceuticals from the U.S. supply chain. Lawmakers said they were unable to bridge longtime disagreements between the FDA and drugmakers over the scope and cost of the system, which would track drug shipments from factory to pharmacy using electronic barcodes or tags.

(AP) ? A lot of people gripe when they get high summertime electric bills. But Kristin Harriger's bill was nearly $1.4 million.

The Abilene, Texas, woman immediately called her provider, Potentia Energy. She quickly learned that her bill was an error.

The utility provider also excused a $66,000 late fee listed on the bill.

Potentia told the Abilene Reporter-News (http://bit.ly/LIdYBn ) it had flagged the bill and had marked it to be held, but the bill mistakenly got sent out.

The bill said Harriger was being charged 100,000 cents, or $1,000, per kilowatt hour. The normal rate ranges from 8.2 cents to 12.1 cents.

Carmen Balver, director of the nonprofit protection group Consumer Watchdog recommended contacting state officials if people run into difficulty while trying to settle a dispute about an over-the-top bill.

Buying and Selling of Real Estate in Germany

Urban Thier Federer & Chinnery, P.A., with offices in the United States, Germany and the United Kingdom, advises US and UK clients with regard to buying and selling real estate in Germany. There are very substantial differences with regard to the transfer of ownership to real estate in Germany, compared with what our UK and US clients are used to seeing in their home countries.

I. Notar: Title to real property is transferred and registered via a contract which has to be concluded in front of a Notar. The German ?Notar? is very different from the ?Notary public? in the US. The Notar is a quasi-judicial entity who ensures that parties to a real estate transaction are fully informed of the consequences of their actions. The Notar has to be a fully qualified lawyer, with additional educational requirements. He/she does not represent any one party in the transaction but advises both parties with regards to the legal consequences, potential problems and issues of a real estate transaction. The German Notar cooperates closely with the attorneys of buyer and seller and last but not least insures that the public register (Grundbuch) for real estate is accurately changed. Urban Thier Federer & Chinnery cooperates closely with Notars all over Germany to ensure an efficient transaction process. We provide our clients with translated documents and explain the unfamiliar details of such a transaction to the US or UK client.

II. Public register, ?Grundbuch?: There is no such thing as title insurance in Germany. The buyer may rely in good faith on the correctness of the public register. We coordinate the payment process in Germany, we monitor the release or recording of encumbrances, such as mortgages (?Hypothek? or ?Grundschuld?) or easements in Germany, while we advise the US client through our offices in the US or UK in his/her native language.

III. Escrow in Germany: Further, we hold funds in escrow for our client to ensure that there will be no payment delays due to to international wiring delays.? Boys golf finishes fifth at regionals

After a strong season that added a KLAA Kensington Conference championship and Oakland County Championship to their trophy case, Novi's boys golf team fell short of qualifying for the June 15 state meet when they finished fifth at Regionals June 7 at Timber Trace Golf Course in Pinckney.

After finishing fifth in their district, where the top six teams qualify for Regionals, Novi landed fifth in Regionals, where only three teams qualify for States. Sixth-place district qualifier Detroit Catholic Central grabbed the third spot at Regionals with a score of 312, edging out White Lake Lakeland's 314 and Novi's 319.

The Wildcats were led by sophomore Garret Buckley's score of 76, which was ninth overall, but almost made the individual cut for players whose team did not qualify. The three individual qualifiers all scored a 75, while Buckley was one of three to score a 76 among individual hopefuls.

Also scoring for Novi was senior Johnny Walker in 18th with 79, junior Brad Kozinski and Bryan Fegert tying for 32nd with 82 and then junior Jason Carless, whose score didn't go toward the four-person team total, finished 56th with 87 among a field of 72 golfers.

Boys Lacrosse

The post-season run for Novi's boys lacrosse team wasn't as long as last year as the No. 17 Wildcats (15-5) ran into a Birmingham Seaholm team on a hot streak. Novi was stop number four on a five-game winning streak for the No. 19 Bulldogs (11-11), who got the best of the ?Cats 19-13 May 29.

Seaholm knocked off No. 19 Northville (11-9) - who had just defeated No. 7 Detroit Catholic Central (11-6) 10-9 in overtime three days prior - 15-12 on June 1 before No. 1 Birmingham Brother Rice (19-2) stopped the neighboring Bulldogs 17-6 June 6 to set up a state final between Brother Rice and No. 3 Ann Arbor Pioneer (21-0).

3 Chinese officials suspended over forced abortion

BEIJING (AP) -- China suspended three officials and apologized to a woman who was forced to undergo an abortion seven months into her pregnancy in a case that sparked an uproar after graphic photos of the mother and her dead baby were circulated online.

The moves appeared to be aimed at allaying public anger over a case that has triggered renewed criticism of China's widely hated one-child limit. Designed to control the country's exploding population, the policy has led to often violently imposed forced abortions and sterilizations as local authorities try to meet birth quotas set by Beijing.

Feng Jianmei, 23, was beaten by officials and forced to abort the baby at seven months on June 2 because her family could not afford a 40,000 yuan ($6,300) fine for having a second child, Chinese media reported this week.

Photos of Feng lying on a hospital bed with the blood-covered baby, reportedly stillborn after a chemical injection killed it, were posted online and went viral, prompting a public outpouring of sympathy and outrage.

A commentary posted on the official website China.org.cn said the forced abortion "is society's shame." Another said the case exposed the lack of humanity in some administrative officials.

The government of Ankang city, where Feng lives in northwest China's Shaanxi province, said a deputy mayor visited Feng and her husband in the hospital, apologized to them and said officials would be suspended amid an investigation.

"Today, I am here on behalf of the municipal government to see you and express our sincere apology to you. I hope to get your understanding," Deputy Mayor Du Shouping said, according to a statement on the city government's website Friday.

Feng and her husband could not immediately be reached Friday. A relative who answered Feng's cellphone said the couple were in talks with city officials.

The official Xinhua News Agency said three officials would be relieved of their duties: two top local family planning officials and the head of the township government.

But one expert said the officials are unlikely to be seriously punished for a problem that has existed for three decades, and that is usually a result of orders carried out to meet the central government's population quotas.

"They're just pulling a trick to deal with the public. It's just a pretense," said Liang Zhongtang, a demography expert at the Shanghai Academy of Social Sciences. "I think this case will end up being ignored and forgotten like similar cases were in the past. Things have always been like this. Nobody will be fired."

China legalized abortion in the 1950s, but it didn't become common until the government began enforcing a one-child limit to stem population growth.

From fewer than 5 million abortions a year before 1979, the numbers jumped to 8.7 million in 1981, a year after the one-child policy was launched. It peaked in 1983 at 14.4 million before coming down as China relaxed the policy to allow rural couples a second child if their first was a girl.

Xinhua said Feng was not legally entitled to a second child under China's one-child limit because she did not have a rural household registration, but added that late-term abortions are prohibited due to the risk of causing physical injury to the mother.

"The correct way to deal with the case would have been for local officials to allow her to deliver the baby first, and then mete out punishment according to regulations," the agency quoted an anonymous provincial family planning official as saying.

Abuses by family planning officials are often a target for popular frustration, especially amid a growing sense among better-off Chinese that the government has no right to dictate how many children people should have.

One reason that activist Chen Guangcheng enjoys a wider appeal within China than many other activists is that he and his wife documented complaints about forced abortions and sterilizations in the city that oversees his village. Among the cases were several women who said they were forced to have abortions within days of their due dates.

The couple's efforts angered local leaders. Chen was jailed and later placed under illegal house arrest, from which he fled six weeks ago in a daring escape. He is now living in New York with his wife and two young children.

The government says the one-child policy has prevented an additional 400 million births in the world's most populous country of 1.3 billion.

Critics of the controls point out that it leads to a dangerously imbalanced sex ratio. Families abort girls out of a traditional preference for male heirs.

(AP) ? Syrian troops shelled the southern city of Daraaa early on Saturday, killing at least 15 people, activists said. And in Damascus, residents spoke about a night of shooting and explosions in the worst violence Syria's capital has seen since the uprising against President Bashar Assad's regime began 15 months ago.

The latest escalations in different parts of Syria are another blow to international envoy Kofi Annan's peace plan, which aims to end the country's bloodletting. Annan brokered a cease-fire that went into effect on April 12 but has since been violated hundreds of times and never properly took hold.

The U.N. said several weeks ago that at least 9,000 people have been killed since the crisis began in March last year while Syrian activists say the violence has claimed the lives of more than 13,000 people.

Damascus resident and activist Maath al-Shami said clashes between rebels and troops in the city's neighborhoods of Qaboun and Barzeh lasted until about 1:30 a.m. Saturday.

On Friday, government troops clashed with rebels from the Free Syrian Army in Damascus' Kfar Souseh district in some of the worst fighting yet in the capital. The clashes were a clear sign that the ragtag group has succeeded in taking its fight to the regime's base of power.

Since the start of the uprising, Damascus had been relatively quiet compared with other Syrian cities. The capital and the northern city of Aleppo, the country's largest, are under the firm grip of Assad's security forces.

"Yesterday was a turning point in the conflict," said al-Shami via Skype. "There were clashes in Damascus that lasted hours. The battle is in Damascus now."

Al-Shami added that troops shelled Qaboun and Barzeh with tanks until after midnight Friday adding that at least four people were killed. Al-Shami added that tanks withdrew before sunrise Saturday and the area has been relatively quiet.

Another resident in the capital, who refused to be identified for fear of reprisals, said "we spent a night of fear." The resident added that the shooting and explosions in the capital "were the worst so far."

To the south, in Daraa, the Britain-based Syrian Observatory for Human Rights said 17 people were killed in the shelling, while the Local Coordination Committees said 15 civilians lost their lives. Both groups said dozens of people were also wounded in the shelling early Saturday.

Daraa is the city where the uprising against Assad's regime first erupted in March 2011. A Daraa-based activist, Adel al-Omari, said the shelling of the city's Mahata area began randomly and lasted until after midnight.

"People were taken by surprise while in their homes," said al-Omari, adding that regime targeted the neighborhood with mortars.

The LCC said that the dead included a father and his two children of the Abazeid family whose home was destroyed by the shelling. The group added that five of the dead were members of the Daloua family.

The LCC and the Observatory also reported shelling and clashes in the central city of Homs, one of the main battlegrounds of the uprising.

On Friday, U.N. observers entered a farming helmet in the central province of Hama where activists said nearly 80 people were massacred on Wednesday. A U.N. spokeswoman said the observers could smell the stench of burned corpses and saw body parts scattered around the deserted village of Mazraat al-Qubair.

The observers were blocked by government troops and residents, and coming under small arms fire when they tried to enter the area on Thursday.

The scene held evidence of a "horrific crime," said U.N. spokeswoman Sausan Ghosheh.

The U.N. team was the first independent group to arrive in Mazraat al-Qubair, a village of about 160 people. Opposition activists and Syrian government officials blamed each other for the killings and differed about the number of dead.

Activists said that up to 78 people, including women and children, were shot, hacked and burned to death, saying pro-government militiamen known as "shabiha" were responsible. A government statement on the state-run news agency SANA said "an armed terrorist group" killed nine women and children before Hama authorities were called and killed the attackers.

Ghosheh, the U.N. observers spokeswoman, said the residents' accounts of the mass killing were "conflicting," and that they needed to cross check the names of the missing and dead with those supplied by nearby villagers. Mazraat al-Qubair itself was "empty of the local inhabitants," she said.

Chinese stocks drop ahead of data report

China?s stocks fell yesterday, capping the biggest weekly slide this year, after the country?s first interest-rate cut since 2008 intensified concern that the economic slowdown is deepening, ahead of today?s release of last month?s economic data that may show fixed-asset investment expanded at the slowest pace in a decade.

?Investors are quite concerned the data tomorrow may be very bad,? said Zhang Yanbin, an analyst with Zheshang Securities Co in Shanghai. ?Investors are still contemplating the effects of the interest-rate cut.?

The Shanghai Composite Index slid 11.68 points, or 0.5 percent, to 2,281.45 at the close. The index sank 3.9 percent this week, the most since the five days ended on Dec. 16. The CSI 300 Index fell 0.7 percent to 2,542.33.

Industrial & Commercial Bank of China Ltd (??????) and China Construction Bank Corp (??????) led declines for lenders after Nomura Holding Inc and BoCom International Holdings Co said the rate cut would hurt bank earnings.

China?s biggest lenders raised deposit rates hours after the central bank lowered its benchmark and gave them more freedom over pricing, underscoring the competition for funds and driving their shares lower.

These big banks set the rate on demand deposits at 0.44 percent, according to their Web sites. That?s the maximum allowed under new rules that let them pay 1.1 times the 0.4 percent policy rate.

The People?s Bank of China (PBOC) on Thursday lowered the key one-year deposit and lending rates by 0.25 percentage point. The one-year lending rate declines by a quarter percentage point and the one-year deposit rate drops the same amount, to 3.25 percent.

?The changes in the lending and deposit rate bands will accelerate bank competition and squeeze net interest margins,? May Yan, a Hong Kong-based analyst at Barclays PLC, wrote in a note. After the change in regulation, investors ?may start to see differentiated bank business models and performance, which could be long-term positive.?

The PBOC on Thursday said banks may pay as much as 10 percent more than the benchmark on deposits, the first time a premium is being allowed.

Lenders are also permitted to offer a 20 percent discount on borrowing costs, wider than the previous 10 percent, effective yesterday. The extra leeway banks will get to determine rates at variance from the official setting was called a ?milestone? by UBS AG.

NEW: California voters OK 63% of tax measures

Local voters approved 63 percent ? or 55 of the 87 ? local tax, bond or fee measures on the June 5, 2012 California primary ballot, according to Michael Coleman, the creator of CaliforniaCityFinance.com. Majority vote measures fared much better than supermajority votes requiring two-thirds approval to pass special taxes and bonds.? Fifteen of the 19 majority-vote measures passed (79 percent). But only 18 of the 34 supermajority vote taxes passed (53 percent).

For schools, voters favored approval by 66 percent; that?s compared to 45 percent for non-schools.

Analysts will not get much direction from these local election results in trying to handicap the mood of voters to pass Gov. Jerry Brown?s $8.5 billion tax increase initiative this November. Even though a balanced budget is constitutionally required to be approved by June 15, it was just reported that the leadership in the Legisalture still refuses to cut $2 billion in social spending to meet Brown?s budget proposal, which itself appeared to analysts already to have a $4 billion deficit.

The results below confirm that voters support their own local schools. But it is unclear if they will tax themselves more for the benefit of the state.

School Parcel Taxes

Of the school parcel taxes measures requiring a two-thirds supermajority, nine?the 13 passed (69 percent). ??All received well over 60 percent yes votes.

School Bonds Requiring 55 percent Approval

Of local school bond measures requiring only the the 55 percent threshold passed, 23 of 34 passed (77 percent). They will raise?$1.9 billion.

Local Add-On Sales Taxes

For use sales-tax add-ons, eight of nine cities were approved (89 percent).?Only the City of Alameda failed, because the earmarking of the use of the tax required a two-thirds majority approval.? Since 2001, about 60 percent of measures to increase general purpose local sales taxes have passed, but only 36 percent special sales tax increases requiring a two-thirds majority vote have passed.

Transient Hotel Occupancy Taxes

Two of the five ballot measures to increase or expand hotel Transient Occupancy Taxes passed (50 percent).

Utility User Taxes

Of the two utility user tax measures on the ballot, both failed. An ?advisory? vote in Stanton on how to spend the money passed, but was irrelevant.

Business License Taxes

Two of the four business license tax increases passed, one failed, and a third, San Mateo Vehicle Rentals, is still too close to call.

Parcel City and Special Taxes

Only four of the 14 of the city parcel and special district parcel tax increases passed (29 percent). Proposition 13 requires two-thirds supermajority approval.

General Obligation Bonds

Both cities that attempted to gain the two-thirds voter approval to issue general obligation bonds failed. By comparison, over the last 12 years, about 50 percent of the general obligation bond measures have passed.

Employee Benefit Changes

Both of the public employee pension reform proposals passed with big majorities.

Appointed City Clerk, Treasurer, Administrator

Orange County?s Measure A failed. It was a proposal to have the Board of Supervisors appoint the county public administrator, who protects the assets and manages the affairs of residents of the county who die with no known heirs, will or executor. Also failing were efforts to deny voters the right to elect the city clerk and city treasurer in Ukiah and Antioch.? But Calexico approved similar measures.

Charter Cities

Voters in El Cajon approved the establishment of a city charter, but voters in Auburn turned down charter city status.
