An editorial in PLOS Medicine makes the case for considering the poor eating habits of shift workers, and the associated health risk, as a legally defined occupational hazard. Sophie Bushwick reports.

For shift workers, odd hours usually mean strange sleeping habits and unhealthy meals. And now an editorial in the journal Public Library of Science Medicine takes the position that unhealthy eating associated with unusual working hours could be considered a new form of occupational hazard. Because such eating is a risk factor for obesity and diabetes. [Poor Diet in Shift Workers: A New Occupational Health Hazard?]

More than 15 percent of workers in the United States are employed in shifts, with workers taking over for each other so that the establishment can stay open for up to 24 hours a day. Because some shifts take place at night, employees have their circadian rhythms disrupted, and thus their metabolisms.

Taking round the clock shifts also makes eating a good diet and getting sufficient exercise difficult. A recent study in the same journal found an increase in diabetes risk among nurses who performed shift work. The editorial suggests not only employee incentives, but also legislation to make healthful diets easy and cheap. It concludes that treating poor eating among shift workers as an occupational hazard is consistent with the history of workplace safety rights.

    Deadly Conn. fire caused by old fireplace embers (AP)

    STAMFORD, Conn. ? A Christmas morning fire that killed a couple and three of their grandchildren was accidentally started by fireplace embers that had been discarded near a first-floor entryway, officials said Tuesday.

    The officials also said it wasn't clear if the home had working smoke detectors. Stamford Mayor Michael Pavia called the fire a "tragic accident," not the result of foul play.

    Sometime between 3 a.m. and 3:30 a.m., a friend staying in the home put fireplace ashes in a bag and left it either in or outside a mudroom and trash enclosure attached to the rear of the house, said Barry Callahan, Stamford's fire marshal. The fire was reported just after 4:40 a.m.

    "The fire entered the house quickly and spread throughout the first floor and up two interior vertical openings, trapping the occupants on the upper floors," Callahan said.

    Officials described a frantic scene after rescuers arrived early Sunday.

    Neighbors said they were awakened by screams shortly before 5 a.m. and rushed outside to help but could do nothing as flames devoured the large Victorian home.

    Stamford acting Fire Chief Antonio Conte said the children's mother, Madonna Badger, had climbed out a window onto scaffolding and then a flat roof. She was screaming for her children and pointed firefighters to the third floor.

    Firefighters climbed to the third floor twice, but the heat and flames were too intense and the children were not where they thought they would be, he said.

    The friend of Badger's who had been staying in the home told investigators he actually had led two of the girls downstairs, but heat from the flames separated them, Conte said. One apparently went back upstairs and another one was found with her grandmother at the bottom of the stairwell between the second and third floors, he said.

    Badger's father, Lomer Johnson, was found outside. It appears he had been planning to help one of the girls get out; she had been placed on a pile of books, so he could reach in and grab her, officials said.

    "When he went out the window, that's when he succumbed and she died just inside the window," Conte said.

    Flames were shooting out of the house when firefighters arrived, said Brendan Keatley, a Stamford firefighter who was at the scene and president of the local firefighters union.

    "Two sides of the structure were walls of flame," Keatley said.

    Firefighters used a ladder and construction scaffolding outside the house to reach the third floor, but they ran into extreme heat and poor visibility in a hallway, Keatley said. Four firefighters were injured as they searched for the victims, including a captain who suffered second-degree burns on his face, Keatley said.

    Fighting the fire took a physical and an emotional toll, he said, and counselors were being made available to firefighters.

    "We are devastated, just like everybody else is devastated," Keatley said Tuesday.

    Badger, a New York advertising executive who owned the home, and her male acquaintance escaped. Her parents, Lomer and Pauline Johnson, who were visiting for the holidays, were killed, as were her three daughters ? 10-year-old Lily and 7-year-old twins Grace and Sarah.

    The home's second floor was being renovated and Badger was awaiting a final inspection before she could get a final certificate of approval, said Ernie Ogera, director of operations for the city of Stamford.

    There were plans for hard-wired smoke alarms, but they had not been hooked up, Ogera said. Officials did not know whether battery-operated ones were being used.

    The Johnsons lived in Southbury, about 45 miles northeast of Stamford. Lomer Johnson had worked as a department store Santa Claus this season after a long career as a safety chief at Louisville, Ky.-based liquor maker Brown-Forman Corp., which he retired from several years ago.

    The acquaintance who escaped, Michael Borcina, is a contractor who had done work on the home.

    The severely damaged Victorian house situated along the Connecticut shoreline was torn down Monday after the buildings department determined it was unsafe and ordered it razed, Stamford fire Chief Antonio Conte said.

    Badger, an ad executive in the fashion industry, is the founder of New York-based Badger & Winters Group. She was treated at a hospital and was discharged by Sunday evening, a hospital supervisor said. Her whereabouts were unknown.

    A person answering the phone Tuesday at the Badger & Winters Group said it had no statement or comment.

    Borcina was listed in fair condition Tuesday at Stamford Hospital, meaning his vital signs were normal but he may be uncomfortable. He declined to comment through a hospital spokeswoman.

    Borcina, 52, of New York City, is the owner of Tiberias Construction Inc., which renovates expensive homes and businesses. The company's projects have included a Donna Karan store and artist Alex Beard's studio, both in New York City, and the White House Christmas wishing tree, according to the construction firm's website.

    Borcina and Badger are friends on Facebook, and he said on his Facebook page that he enjoys skydiving and scuba diving.

    Property records show Badger bought the five-bedroom, waterfront home for $1.7 million last year. The house was situated in Shippan Point, a wealthy neighborhood that juts into Long Island Sound.

    The lot where the house stood was covered with charred debris and cordoned off by police with tape on Monday. Passers-by left floral bouquets, stuffed animals and candles.

    Badger previously spent time on Shelter Island, a small, exclusive community at the eastern end of Long Island, N.Y. Town Supervisor James Dougherty said Tuesday that Madonna Badger served a few years ago on the town's deer and tick committee, which oversees the town's program to maintain healthy deer while eliminating tick-borne diseases.

    "The Railway Act does not specifically state that the SRT can manage the market," Sanya Jantarat, an adviser to Bangkok Governor MR Sukhumbhand Paribatra, told a news conference.

    He was speaking after it was reported that the Cabinet on Tuesday issued a resolution assigning the SRT to manage Chatuchak Market from January 2 onward.

    The BMA established Chatuchak Market a few decades ago. Under its management, the market has grown into a world-famous attraction popular not just among Thais but also with foreign tourists. The cash flow within the market is said to be huge.

    "We are ready to respond to the Cabinet resolution, but we have to examine it first," Sanya said. "We have concerns for consumers and vendors at the market."

    He said many parties now wondered which agency would take charge of the Chatuchak Market next year.

    Sanya said the BMA would ask the government to forward the Cabinet resolution to the BMA to study.

    "We have to examine whether the Cabinet has approved the SRT's management of Chatuchak Market or just the market's grounds," he said.

    If the SRT steps in to manage Chatuchak Market, it may violate the Railway Act, Sanya said.

    The BMA initially paid about Bt3.2 million a year in rent to the SRT for the plot on which the market is located. From 2001, the renewed contract saw BMA paying a much higher rent of more than Bt65 million a year to the SRT.

    In 2008, the SRT raised the rent to about Bt200 million a year and the BMA agreed.

    However, the BMA baulked at the SRT's recent push for an annual rent of Bt420 million. The quarrel over the rent hike finally led the SRT to take over the management of the market.

    There are 8,805 registered stalls inside Chatuchak Market in addition to the stalls illegally operating around the site.

    "I think I am going to face a higher rent fee," a clothes vendor at the market said yesterday. "That's the reason the SRT wants to take over from the BMA anyway."

    Identifying himself only as "Supoj", he disclosed that he paid Bt25,000 a month for the right to operate his stalls. The rent was paid not to the BMA, but to people holding the right to lease the stalls.

    "Most vendors here are sub-lessors," said Pornronnarong Nopdejchatchai, a 43-year-old shoe vendor.

    There are three main groups of profiteers at Chatuchak Market.

    The first group purchased the right to lease stalls from the original rights owners and sub-leased the stalls at a much higher fee. Key figures in this group are identified only as "Je Or" and "Seh Por". This group reportedly pockets a lump sum of about Bt1.5 billion from Chatuchak vendors each year.

    The second group governs more than 1,000 unregistered or illegal stalls at the market. The group is led by someone known only as "Bro Yai". His gang collected Bt1,000 a day from each of the illegal stalls.

    The last group, reportedly under the leadership of a "Seh Kor", reaps benefits from taxis, public vans, parking areas, and taxi motorcyclists around the Chatuchak Weekend Market.

    Nisit Sintuprai, who chairs a working panel established by a deputy transport minister, said he expected the BMA to hand over the Chatuchak Market to the SRT within six months.

    "In the meantime, we will set up working panels to look into each aspect of the management of the market including contracts, fee collection, laws and regulation of stalls," he said.

    Church brings snow for Christmas in Florida

    A Florida church says about 10,000 people turned out to see something kind of miraculous for the balmy state - a hill of snow.

    Bayside Community Church trucked in 25 tons of snow for a four-day "Family Christmas Spectacular."

    The Bradenton church's director of events, Gregg Ellery, tells The Herald ( http://bit.ly/tw9Z9H) that most of the snow was piled into a hill about 55 feet long and 15 feet tall.

    Children up to age 18 were allowed to take rides down the big snow hill on orange and green discs. A smaller snow pile was made for toddlers to play in.

    The event also included a live nativity scene including two camels, a petting zoo and pony and train rides. It ended Saturday.

    Lakewood Police Chief Robert Lawson tells the Asbury Park Press that the two teens ? ages 15 and 17 ? were walking in the Ocean County community early Thursday when a Jeep approached them. Five people inside the vehicle ? three male adults and two juvenile boys ? then allegedly threw several eggs at the teens.

    The occupants of the vehicle told the Orthodox teens, ?You better move on you Jew boys,? the Asbury Park Press reported.

    A borough police officer spotted and stopped the vehicle a few blocks away. Lawson says the driver admitted they were responsible for throwing the eggs.

    The five were charged with bias intimidation and harassment, Lawson said. They were issued summonses and released.

    Tens of thousands of protesters pressure Putin (Reuters)

    MOSCOW (Reuters) ? Tens of thousands of flag-waving and chanting protesters called Saturday for a disputed parliamentary election to be rerun and an end to Vladimir Putin's rule, increasing pressure on the Russian leader as he tries to win back the presidency.

    The protesters shouted "Russia without Putin" and "New elections, New elections" as one speaker after another called for an end to Putin's 12-year domination of the country at the second big opposition rally in two weeks in central Moscow.

    "Do you want Putin to return to the presidency?" novelist Boris Akunin asked from a large stage. Whistling and jeering, protesters chanted: "No!"

    Witnesses said at least as many people turned out as at the last big Moscow rally on December 10 to protest against alleged vote-rigging in the December 4 election won by Putin's United Russia party.

    Police said at least 28,000 attended the rally on Prospekt Sakharova (Sakharov Avenue), named after Soviet-era dissident Andrei Sakharov. But one of the organizers, liberal politician Vladimir Ryzhkov, put the crowd size at 120,000. Some climbed lamp-posts or trees to get a better view.

    The big turnout is likely to encourage organizers to believe they can keep up the momentum of the biggest opposition demonstrations since Putin rose to power in 1999, although the prime minister seems intent on riding out the protests.

    "I see enough people to take the Kremlin and the White House (government headquarters) right now!" anti-corruption blogger Alexei Navalny, who has emerged as the most inspirational of the opposition leaders, said to loud cheers.

    "But we are a peaceful force, we won't do it - yet. But if the crooks and thieves continue trying to deceive us and lie to us, we will take (power) ourselves. It is ours!"

    The organizers did not set a date for the next protest. Russia is about to start the 10-day New Year holiday when it would be hard to attract large numbers to rallies.

    PROTESTERS WAVE CONDOMS

    The protesters were heartened Saturday by the Kremlin's human rights council saying a new election should be held, although it is only an advisory body whose recommendations are regularly ignored by Russia's leaders.

    Many of the protesters wore white ribbons, the symbol of the protests, and others carried balloons and flags at the rally, which brought together liberals, nationalists, anarchists, environmentalists and urban youth on a bitterly cold day.

    "The last protest made a huge impression and I want others to come and realize they can stand up for their right. We all know the election results and we all know how dishonest they were," said Andrei Chernyshov, a 22-year-old student.

    President Dmitry Medvedev, who is stepping aside for Putin to return to the Kremlin after four years as prime minister, has promised electoral reforms to relax the Kremlin's grip on power.

    But the opposition has rejected these conciliatory efforts and says Putin and Medvedev have ignored its key demand for a rerun of the poll, in which United Russia won a slim majority.

    The protesters say United Russia benefited from widespread voting irregularities and international monitors said the vote was slanted in the ruling party's favor.

    "The party of swindlers and thieves are the only ones who benefit from the preservation of the status quo," journalist Leonid Parfyonov said on a video message shown on a screen.

    Protesters held signs saying: "For Russia without Putin."

    Others waved condoms blown up like balloons, mocking Putin for saying earlier this month that he had initially mistaken the protesters' white ribbons, pinned to their chests, for condoms.

    One protester carried a poster showing a doctored portrait of Putin with a condom wrapped around his head.

    Dozens of police trucks lined the city's main ring road nearby and the police blocked off roads around the protest site, but they did not intervene.

    There was no immediate reaction to the protests from Putin but state and other tightly controlled television channels provided coverage of the rally, without any direct mention of the criticism of the 59-year-old prime minister.

    PUTIN OUT OF TOUCH?

    Putin is still expected to win the presidential election in March and return to the post he held from 2000 until 2008 - the opposition is divided, has no candidate to unite it and may struggle to keep protests going in mid-winter.

    But there are growing doubts that Putin will win outright in the first round of voting. Many Russians say he is out of touch and some sources close to Russia's leadership suggest he has not grasped the seriousness of the protests.

    The popularity of the former KGB spy, who has remained Russia's paramount leader, has dropped since he and Medvedev announced plans in September to swap jobs next year.

    Many Russians said this showed a disregard for democracy and, although some still admire Putin for restoring order after the chaos that followed the Soviet Union's collapse, others fear his return would bring political and economic stagnation.

    Putin has also alienated many people by suggesting that a large number of people at the protests, which were mainly organized on social networking sites, were paid to turn up and accused the United States of encouraging them.

    "I didn't go to the first demonstration. I didn't think it was worth it. But seeing the news I realized how angry I was that my vote had been stolen," said Mikhail, a 46-year-old real estate salesman who declined to give his full name.

    "You can feel that things are changing among people. There is solidarity among people. We're not afraid any more."

    The New Bus for London (NBfL), also known as the New Routemaster, the Boris Bus and the Tory Mayor's Entirely Shameless Vanity Project (copyright: Team Livingstone) promises a number of environmental advantages over not only its conventional diesel counterparts but also fellow hybrid buses already operating in the capital.

    Transport for London (TfL) tells me that on a simulated London bus route at the Millbrook proving ground the test model NBfL emitted 640 grams of carbon dioxide (CO2) per kilometre compared with 864 grams for a current hybrid and 1,295 grams for a current diesel. It threw out 3.96 grams of mono-nitrogen oxides (NOx) per kilometre, compared with 7.7 grams from other hybrids and 9.3 grams from a diesel. And its fuel consumption was 11.6 miles per gallon, as against 8.6 for a a current hybrid and 5.8 for a standard diesel under similar test conditions.

    Sounds pretty good, though I feel bound to point out that even the NBfL needs a bit of diesel in the tank to make its electric motor work and if it doesn't get enough, embarrassment can ensue - a matter I now pledge never to mention again. But with only eight of Wrightbus's creations ordered to join a fleet that was 8,528 strong as of March this year, how green is the capital's surface public transport these days?

    Not as green as had been hoped when Boris became mayor, I'm afraid. When TfL announced in December 2008 that it was to quadruple London's hybrid count to 56 it also said that "a further 300 hybrid buses will be in operation by 2011," and that it and Boris's commitment to hybrid technology meant that "by 2012" it expected all new buses joining the fleet to be hybrids. A roll out of 500 a year was anticipated, which would have been the largest in Europe.

    Come March 2010 TfL was still sticking to its commitment that by 2012 all newcomers to the fleet would hybrids, but the expectation that "a further 300" would appear by 2011 on top of the 56 previously announced had changed to 300 altogether. And last month, Green Party AM Darren Johnson was told in a written answer by Boris and TfL commissioner Peter Hendy that the target date for 300 hybrids was now "by 2012." As for all newcomers to the fleet being hybrids by then, that hope had bitten the dust. The written answer says:

    TfL plans to introduce approximately 800 new buses in 2012/13, of which 52 will be hybrids.

    Just 52 out of 800. The answer also said that there are 133 diesel-electric hybrids operating at the moment, with a further 184 on order.

    Why the problem? As the Boris/Hendy answer also says, the price of hybrids "has not reduced as originally anticipated." A man at TfL tells me that it's basically down to the confidence of the companies that lease vehicles to the route operators. Hybrids haven't been around very long, so they've yet to prove their staying power over the dozen or more years required. That makes the leasing companies wary of investing in them, which means smaller orders for the bus manufacturers, which keeps the prices of the buses high, which puts the operators off buying them - yer basic economies of scale.

    The TfL man stressed that they're doing all they can to build the confidence required to bring the price of a hybrid down from the ?300,00-315,000 mark to something nearer the roughly ?190,000 of a conventional double decker. It will be interesting to see how many additional NBfLs at ?330,000 a shout Wrightbus is asked to provide.

    Yahoo board continues talks on Asian deal: report (Reuters)

    (Reuters) ? Yahoo Inc's board of directors has agreed to keep exploring a plan to split off the Internet company's Asian assets in a complex deal valued at $17 billion, The Wall Street Journal reported on Friday.

    The company's board of directors decided to move forward with negotiations related to the deal on Friday, while also not ruling out separate investment proposals by private equity firms, the Journal reported, citing anonymous sources.

    Yahoo, which fired Chief Executive Carol Bartz in September, has been undergoing a "strategic review" to revamp growth in its business. The Internet pioneer has struggled to compete with Google Inc, Facebook and other fast-growing rivals.

    The Asian split-off deal would effectively transfer most of Yahoo's 40 percent slice in China's Alibaba Group back to the Hangzhou-based Internet company and all of its stake in Yahoo Japan to Softbank Corps, sources familiar with the matter have told Reuters.

    Alibaba and Yahoo Japan would each create separate legal entities where they would put cash and certain, yet-to-be-determined operating assets, and then trade those with Yahoo, making the deal tax-free, the sources said.

    Yahoo shareholders have applauded the proposed plan, sending shares of Yahoo up nearly 6 percent earlier this week when news surfaced that the plan was under consideration.

    Yahoo shares closed Friday's regular trading session up 1.2 percent at $16.19.

    Private equity firms TPG and Silver Lake have each advanced separate proposals to Yahoo's board that would involve the firms purchasing minority stakes in Yahoo, sources have told Reuters. Those plans have been fiercely opposed by some of Yahoo's largest shareholders, including activist hedge fund manager Dan Loeb of Third Point LLC.

    At the end of the contemplated Asian split-off transaction Yahoo would retain a 15 percent stake in Alibaba, the sources said. The final deal size will depend on how the assets are valued, another source said.

    Yahoo declined to comment.

    Comet's death-plunge into sun will be well documented

    The ill-fated comet Lovejoy is on course to plow through the sun's blisteringly hot outer atmosphere - called the corona - making its closest approach to our star at around 7 p.m. EST Thursday.

    A newly discovered comet is set to make a death dive into the sun's atmosphere today (Dec. 15), and scientists will have a ringside seat to watch its fiery demise.

    The ill-fated?comet Lovejoy?is on course to plow through the sun's blisteringly hot outer atmosphere - called the corona - making its closest approach to our star at?around 7 p.m. EST today (midnight GMT on Dec. 16). At that point, Lovejoy should be just 87,000 miles (140,000 kilometers) ?from the solar surface.

    The comet is not expected to survive this close encounter, experts have said. But if it's any consolation to Lovejoy, the comet's last hours of existence will be well-documented for posterity.?Scientists have trained a phalanx of satellite instruments on the comet, which is what's known as a Kreutz sungrazer.

    Spacecraft watching closely

    All?Kreutz sungrazers?? so named because their orbits bring them close to the sun ? are believed to be the remains of one giant comet that broke apart several centuries ago. They're named after 19th-century German astronomer Heinrich Kreutz, who first demonstrated that such comets are related.

    Comets dive into the sun on a regular basis, but astronomers don't often get much advance notice of the impending event. That's what makes comet Lovejoy, which is officially known as C/2011 W3 (Lovejoy), special. Australian amateur astronomer Terry Lovejoy discovered it on Nov. 27, so scientists have had several weeks to plan their observation campaign. [Death of a Comet: Photos of Sungrazing Comet Lovejoy]

    NASA's Solar Terrestrial Relations Observatory (STEREO) and Solar Dynamics Observatory (SDO) spacecraft will be watching Lovejoy's death plunge closely, as will the Solar and Heliospheric Observatory (SOHO), a satellite mission operated jointly by the European Space Agency and NASA.

    Japan's Hinode spacecraft, which carries some NASA instruments, will also record the comet's last moments. Particle collisions may generate X-rays as Lovejoy streaks through the corona, so Hinode might capture X-ray images of the comet, researchers said.

    Though comet Lovejoy is just 660 feet (200 meters) or so wide, it should put on quite a show as it nears the sun. The comet could become as bright as Jupiter or Venus in the sky just before it's destroyed, according to the skywatching website?Spaceweather.com.

    Possible target for (careful) skywatchers

    Lovejoy may end up being one of the brightest Kreutz sungrazers ever seen, researchers said. While the sun's glare will likely hide it from Earthbound skywatchers' eyes, there's a small chance that blocking the sun out ? behind a building, for example ? could bring the comet into view. WARNING: Never look directly at the sun with your unaided eye or through binoculars or telescopes without special light filters. Severe eye damage can result.

    The comet will make its close solar approach around sunset for observers across the continental United States, which could afford a viewing opportunity, experts said.

    "If you have one of those nice sunsets where you can actually look right at the sun, be on the watch for the comet on the left of the sun (for northern hemisphere observers)," Karl Battams, a scientist at the Naval Research Laboratory in Washington, D.C., wrote on the?Sungrazing Comets website?Wednesday. Battams runs the site, which is devoted to comets discovered by the SOHO and STEREO spacecraft.

    Battams cautioned readers, however, never to point a telescope or binoculars at or near the sun; permanent eye damage can result. Staring directly at the sun with the naked eye is also a very bad idea, so aspiring comet-watchers should exercise great care.

    Those of us on the ground may get a spacecraft's-eye view of Lovejoy's demise anyway. NASA is planning to set up a special website showing what its SDO satellite sees during the comet's death dive. The space agency will publish the website's URL sometime this afternoon via its website: http://www.nasa.gov, officials said.

    The winner of "The X Factor" is ...

    Melanie Amaro.

    After her name was announced, Melanie was utterly speechless. All she could do was whisper, "Oh my god," several times when Steve Jones tried to get a comment out of her. Her family rapidly rushed the stage to hug her, while her mentor, Simon Cowell, commented: "America, thank you for giving this girl an opportunity ... She is a star, I'm very proud and very grateful."

    Somehow, Melanie was expected to perform after hearing the news. It was perhaps the first time all season that she sounded less than perfect. She was understandably forgetting the words and missing her cues as she sobbed, surrounded by family and the other contestants.

    After the performance, she finally managed to gather herself enough to address her fans. "Thank you so much," she sobbed. "I don't even know what to say -- God is good!" Simon Cowell succinctly summed up the night by insisting, "We came here to find a superstar and we found a superstar."

    Josh Krajcik came in second. Chris Rene came in third.

    If you're interested in what happened during the rest of the show, here are some highlights:

    We kicked off with a supremely awkward group number (what else is new?) in which the final 12 performed Lady Gaga's "The Edge of Glory" with no discernable sense of timing or harmony. Thankfully, some enterprising individual backstage made certain that Lakoda Rayne's microphones were turned down, but there was no disguising how shaky Chris Rene sounded and Rachel Crow pretty much shouted her lines. An inauspicious start, to say the least.

    The final three then had the opportunity to perform one more time -- without the added pressure of shilling for votes. Melanie was up first with a typically Mariah-esque rendition of "All I Want For Christmas Is You," which was note-perfect, as always. She was certainly the most vocally accomplished finalist, but I do understand the concerns of her critics who argue that her performances all sound the same or seem derivative of other artists. Because her tone is similar to the Whitneys, Mariahs and Beyonc?s of the world, it will be far harder for her to carve out a niche for herself in the crowded female music marketplace, while Josh and Chris undeniably have more unique sounds. L.A. praised Melanie enthusiastically (for once), insisting, "That beautiful voice you have is the best friend a song has ever met." Nicole took the opportunity to get in one more nonsensical critique, calling Melanie a "princess goddess warrior."

    Chris followed with "Have Yourself a Merry Little Christmas," and no matter how much I respect and admire the guy for how far he's come, he still can't carry a tune. He hit some smooth notes in his upper register, and warmed up to the song as it progressed, but ... yikes. Simon admitted that the competition would not have been the same without Chris, calling him an inspiration. Paula called him stylish and stylized and in possession of great style (we have a new drinking game!), before dubbing him the "most original" contestant.

    Last up was Josh, with a raspy and engaging rendition of "Please Come Home For Christmas." He seemed confident and comfortable on the stage, without any need for gimmicks. I think Simon was completely right when he predicted that Josh would sell a lot of records in the future. L.A. admitted (rightly) that judging Josh has been the toughest this year. "You've been so good that I'm always at a loss for words when it comes to you," he said, while Paula called him "magical."

    Then came an unlikely duet of "The Christmas Song" between Justin Bieber and Stevie Wonder (I wonder how much of a bump the ratings got thanks to the Beliebers), before the teen pop icon tackled "Santa Claus is Coming to Town" solo. Bieber brought Drew out to sing the last line and made my cold, cynical heart melt; what would "The X Factor" finale be without one last teenage meltdown? Steve Jones acted like the drunken uncle who embarrasses you every year at Christmas dinner, by pointing out that Drew's dream was to hold hands with Justin on a beach as they watched the sun go down. Classy, Steve -- this is why everyone wants you fired. I am MORTIFIED on Drew's behalf, but she took it with grace and good humor, and I'm not going to lie, I'm thrilled for her; that moment was probably as good as winning the whole competition to her.

    With much fanfare and prevaricating, our third-place contestant, Chris Rene, was revealed. I've got to say, I was shocked (and pleased) that the voters didn't let a compelling back-story distract them from vocal weakness, and I know that Chris will go on to sell plenty of records under either L.A. or Simon's tutelage, so it doesn't feel like much of an injustice. Chris remained a gentleman to the end, remarking, "I feel amazing that I got to do this, that I'm here, and that God has blessed me with so many opportunities. I've just gotta say thank you." L.A. insisted that he was still proud of his contestant and that Chris was still his man.

    Then Steve did a terrible job of corralling Josh and Melanie back to the stage, leading to an abrupt cut to commercials. When we returned, we marched right back into awkwardsville by revisiting the top five most shocking moments of the season, culminating in Rachel Crow's traumatic elimination. Luckily, Rachel then joined our hapless host on stage to prove that she hasn't been committed to any kind of psychiatric facility following her breakdown, and after reassuring her fans that good things are coming soon for her, she told Steve that she wanted to steal his job. Can I register my approval of this idea now? Her 20 seconds reading from the teleprompter seemed more natural and charismatic than Steve has appeared all season. She introduced Leona Lewis, who proceeded to show everyone how it's done with a flawless rendition of "Run."

    So. Much. Filler.

    50 Cent and the L.A. Lakers took the stage for "Wait Until Tonight" and "In Da Club," the latter of which also featured Astro, who held his own admirably. Is 50 Cent any more relevant than Avril Lavigne these days, though? After an embarrassing Nicole vs. Paula "cry-off" segment, they rolled out Pitbull featuring Ne-Yo (and Marcus Canty!), and I found my will to live rapidly eroding.

    Melanie and Josh then gave us a very cute duet of "Heroes" that proved to be an excellent showcase for their talents, even if their voices didn't mesh particularly well on the harmonies. The two had great chemistry, but I was mostly just relieved that Chris wasn't part of the final two, since there's no way he could've held his own against Melanie or Josh's crisp vocals.

    Then, at long, long last, the winner was finally revealed, and Melanie's tearful celebration was hard-earned and incredibly touching. Josh was a graceful runner-up, praising his competition for her great voice and remarking that he was glad that he had been able to be himself and sing the songs that he wanted to sing throughout the competition.

    So Melanie Amaro has been crowned our first ever champion of "The X Factor" in the U.S., with a Pepsi commercial and massive recording contract to keep her occupied. We may never know if it was pure talent that won her the top spot, or Simon Cowell's careful PR management that painted her as an underdog, even when she was the strongest competitor; but based on vocal talent, the Floridian was undeniably deserving.

    Still, some burning questions remain: Will the cardboard cutout that passes for a host, Steve Jones, return to abruptly cut off the judges and inadvertently insult the losers again next season? Will Nicole Scherzinger be entrusted with mentoring another batch of competitors when she seems to think that she still is one? Will more people tune in? We'll find out next year.

    China mourns Kim Jong Il, hints at inviting heir (AP)

    BEIJING ? Chinese President Hu Jintao offered his condolences Tuesday on the death of Kim Jong Il as the government hinted at an early invitation for a visit by his son and successor.

    Surrounded by scores of security officers, Hu made an early morning trip to North Korea's sprawling embassy in Beijing's leafy Jianguomenwai diplomatic district, where the national flag was flying at half-staff. The official Xinhua News Agency reported the visit but offered no other details.

    That followed a meeting Monday evening between the embassy's second-highest-ranking official and Chinese Foreign Minister Yang Jiechi, who called Kim a "close friend" who would be remembered forever by the Chinese people. The ruling Communist Party's Central Committee, China's top policy-setting body, hailed Kim's son and successor Kim Jong Un on Monday as North Korea's new leader.

    Foreign Ministry spokesman Liu Weimin left the door open for an invitation to the younger Kim, noting that China maintains high-level exchanges with North Korea.

    "We would welcome North Korea's leaders to visit China at their convenience," Liu told reporters at Tuesday's daily briefing. The words Liu used could refer to one leader or more than one leader.

    China has been expected to push for an early visit by the younger Kim to cement ties with the new leadership, in contrast to the six-year gap between his father's rise to power and his first trip to Beijing. The younger Kim is believed to have already visited China at least once as part of his father's retinue.

    In the Chinese border city of Dandong, visitors delivered flower arrangements Tuesday to the customs office but all appeared normal otherwise. Tourist boats on the Yalu River cruised along the North Korean bank and trucks rumbled across the rickety bridge connecting the sides.

    Dandong is the main crossing point for travelers and goods between the countries and a nearby island was designated earlier this year as the site of an experimental cross-border joint economic development zone.

    China's response to Kim's death highlights the government's growing emphasis on North Korean ties despite its annoyance at the North's refusal to reform its listless economy and its recurring provocative acts against South Korea that whip up tensions in the region.

    Beijing sees North Korea as a strategic bulwark against a democratic South Korea allied with the U.S. In recent years it has become North Korea's indispensable diplomatic protector and economic partner, accounting for the bulk of its trade, much of its investment and all of its oil. In recent years, Kim was a frequent visitor to China, coming twice this year alone, most recently in August when he stopped off while returning home from Russia.

    Chinese experts say they don't anticipate any change in relations but that Beijing will likely beef up security to guard against disorder that could potentially send millions of impoverished, starving refugees across their long border.

    Above all, China wants to preserve the North Korean regime and ensure stability on the Korean peninsula, while hoping also for economic reforms that will make the North less reliant on Chinese help.

    Viacom partners with live streaming service Ustream (Reuters)

    NEW YORK (TheWrap.com) ? Viacom announced on Thursday an exclusive content agreement with live video streaming company Ustream.

    The deal partners Ustream with Viacom networks like MTV, Comedy Central and VH1 for the digital distribution of live content for events such as MTV's "O Music Awards" and "Live in NYC."

    "We are steadfast in our mission to provide our audience a front row seat and exclusive access to pop culture's biggest events," Dermot McCormack, Executive Vice President for Digital, Viacom Media Networks, said in a statement.

    The partnership begins with a live stream of Sunday's "VH1 Divas Celebrates Soul" Red Carpet, which will be simulcast on both Ustream and VH1.com. VH1 just announced that the show will include a tribute to Amy Winehouse.

    "The VH1 Divas Celebrates Soul Red Carpet is the perfect occasion to officially launch our partnership with Ustream, which we are confident will only expand the reach of our digital specific live streams to an even larger audience base," McCormack said.

    Report says western states edging toward recovery (AP)

    LAS VEGAS ? The West is recovering faster than the nation as a whole, but employment across the region remained far below pre-recession levels and the housing market showed few signs of improvement, according to an economic report released Thursday.

    The report prepared by Brookings Mountain West researchers at the University of Nevada, Las Vegas focused on economic growth in 10 metropolitan areas spread across Nevada, Arizona, New Mexico, Utah, Colorado and Idaho.

    Overall, the region saw a modest 0.3 percent growth in employment in the quarter ending in September, compared to the national rate of 0.1 percent, the study found. Utah, Colorado and New Mexico ? states that have built broad economic bases ? struggled the least, researchers said. In Arizona and Nevada, the housing collapse continued to limit job growth.

    "We don't have a robust, steady recovery yet," said Mark Muro, policy director for the Brookings Metropolitan Policy Program. "The real estate crack up continues to have a severe influence on the places that struggle with it."

    In all, every metropolitan area lagged behind pre-recession employment levels, with Phoenix and Las Vegas experiencing the sharpest differences. Job levels languished 10.8 and 13.4 percent below their respective pre-recession peaks.

    "The road to recovery remains long and uncertain," the report noted.

    Still, there was enough employment growth in the past year to drive down the unemployment rate in every major metropolitan area singled out by the report. Utah and New Mexico had the lowest unemployment rates, while Las Vegas had the highest at 13.6 percent.

    Leading the recovery were Utah's Ogden and Provo, Albuquerque in New Mexico, and Phoenix. Boise and Las Vegas showed modest signs, but Tucson, Ariz., and Colorado Springs were still struggling, according to the report. Ogden and Provo saw employment rise by 1.5 percent, and Idaho's Boise saw a 1 percent increase in jobs.

    Employment grew by less than 1 percent in Phoenix, Colorado Springs, Salt Lake City and Tucson.

    Among the areas that faced a difficult quarter, such as Denver and Albuquerque, job growth in Las Vegas stagnated ? a sign of Nevada's highest-in-the-nation unemployment rate. In Albuquerque and Denver, job growth fell slightly.

    Manufacturing gains drove the jobs numbers in Provo and Ogden, while government expansion helped Boise grow its work force. Conversely, government layoffs contributed to economic woes in Colorado Springs, Las Vegas, Albuquerque and Denver. Production levels remained depressed in Tucson, Boise, Phoenix and Las Vegas.

    The housing market offered few signs of recovery. Prices across the region remained significantly below last year's totals.

    Still, the report highlighted some positive milestones. Prices remained stagnant or improved in eight of the metropolitan areas for the first time since the recession began in 2007. In Las Vegas and Tucson, home values continued to fall, but at a much slower rate than in previous quarters.

    In the latest sign of hardship for Sin City, prices there saw the biggest drop from last year, at 19 percent. In all, Las Vegas home prices have dropped by nearly 65 percent since 2006. The steep fall means home prices are unlikely to recover in Las Vegas any time soon, according to the report. Nevada tops the nation in foreclosures, with vacant homes dominating many neighborhoods.

    "A lot of people bought five or six houses strictly as an investment," said Mike Young, president of the Nevada Association of Realtors. "People just walked away. The values are too upside-down."

    Hard-hit Tucson, Boise and Phoenix also will not see improved home prices in the foreseeable future, the researchers concluded.

    "They have high foreclosures, they had massive real estate and construction employment that crashed and that kind of crack up has proven to be toxic to places," Muro said.

    Business leaders called the report's findings accurate. In Tucson, where some of the major employers include national banks, health centers and the University of Arizona, officials are trying to promote higher education and attract more technology companies to the region to expand its work force. But the recovery remains weak.

    "The Sun Belt markets have just been hammered by the mortgage meltdown and everything having to do with this economy," said Michael Varney, president/CEO of the Tucson Metropolitan Chamber of Commerce.

    >>> will it make the road safer? the national transportation system says they want all 50 states to ban all personal electronic devices for drivers. nbc's tom costello has details for us this morning. good morning.

    >> reporter: good morning to you. the ntsb does not have any regulatory authority but as the nation's leading safety investigative body, when it talks, people listen, including lawmakers. and the ntsb wants the country to take distracted driving as seriously as it takes drinking while driving. so many families have been touched by distracted driving. 13-year-old marga skee killed when her school bus was rear-ended by a truck driver . somehow her i.d. survived.

    >> i don't understand how this little plastic card came off that bus. but marga did not.

    >> reporter: after this 17-year-old was hit and killed by a distracted driver, utah adopted some of the toughest distracted driver laws in the country.

    >> i'll never have anybody call me mom again. she was my only child.

    >> reporter: and then there was reggie shaw.

    >> when i left that morning, it was definitely not my intention to hurt or harm anyone.

    >> reporter: in 2006 , he crossed the yellow line while texting, killing two men on their way to work.

    >> i thought it was something that i could do. that i could drive down the road and send a text message and be safe.

    >> reporter: now, after yet another chain reaction fatal crash in missouri caused by a distracted teenage driver, the ntsb is making a dramatic recommendation. urging all 50 states and d.c. to ban the use of all portable electronic devices for all drivers. an exception would only be made for emergencies and gps units. but not for hands-free devices.

    >> we know that this recommendation is going to be very unpopular with some people. but we're not here to win a popularity contest. we're here to do the right thing.

    >> reporter: currently, 35 states and d.c. ban texting while driving. ten states and d.c. ban handheld devices . with new government stats for 2010 showing, there are 3,092 fatalities as a result of distracted driving last year. meanwhile, roughly 20% of all drivers, and 50% of drivers between 21 and 24 years of age admit to having texted while driving. but a total ban on all devices?

    >> i think hands-free devices are perfectly okay.

    >> i think it's really good if it's going to save at least one life, it's worth it.

    >> i don't think it will be effective. people will just do whatever they want anyway.

    >> no e-mail. no text. no updates. no calls. it's worth a human life .

    >> reporter: the ntsb says it wants to ban both handheld and hands-free devices because studies prove that people on hands-free devices can often be just as distracted. ann, a lot of civil libertarians here think this is going way too far. and while a total ban really may not happen, it could put pressure on corporations and insurance companies to create new rules for their employees and maybe even their policyholders. back to you.

    Microsoft Tag adds support for QR codes and NFC, seeks barcode dominance

    Last year, Microsoft Tag shed its beta skin and stepped out into the wild world of multi-colored barcodes. Now, Redmond has decided to revamp and expand its system, with additional support for both QR codes and NFC capabilities. The update effectively allows businesses and individuals to create their own proprietary Tags or QR codes, while enabling consumers to scan said codes with their Microsoft Tag apps, or NFC-enabled smartphones. The new features are now available on Android, iOS, Windows Phone and BlackBerry handsets, reflecting Microsoft's ambitions to dominate a space that has yet to fully develop.
